Terms of Service:

The IMBIL services are provided by IMBIL consultancy services ltd a company registered in England and Wales under company number 09825149

This agreement applies as between you,”the Customer” the User of this Website and IMBIL consultancy services ltd, the owner(s) of this Website. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website is intended to constitute a contractual offer capable of acceptance. This Agreement is deemed to occur upon our acceptance of your request for Services. You therefore are deemed to accept these terms and conditions when you request an Account and an Account with log in details have been successfully provided for you to access the Network and use our Services.

 

Disclaimer of warranties:
All materials, information, software, products, and services included in or available through the IMBIL’s web sites (the "content") are provided "as is" and "as available" for your use. The content is provided without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or no infringement. IMBIL’s, its subsidiaries, and its licensors do not warrant that the content is accurate, reliable or correct; that the IMBIL’s web sites will be available at any particular time or location; that any defects or errors will be corrected; or that the content is free of viruses or other harmful components. Your use of the IMBIL’s web sites is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.

 

Limitation of liability:
Under no circumstances shall IMBIL’s, its subsidiaries, or its licensors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, the IMBIL’s web sites. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if IMBIL’s has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, IMBIL’s liability in such jurisdictions shall be limited to the extent permitted by law.

 

Billing, Pricing and Charges:
Usage of IMBIL's services will be charged according to the current price list as made available on the IMBIL site. Changes to our pricing shall become effective immediately upon posting to the site.
IMBIL accepts no liability for any charges assessed by a third party provider when used in conjunction with IMBIL's services. Your access to and use of a service provided by a third party provider is subject to the provider's terms and conditions. As soon as your call is connected to a phone number provided by IMBIL, the call may be charged regardless of whether you are connected to the receiver of the call.
The rates that will be charged for calls will be based on a rate which is exclusive of any applicable taxes and surcharges. This rate will be the rate advertised on the IMBIL website at the time of the call.
Cost of call calculation will be based on the length of the call rounded up to the next nearest full minute.
Payment for IMBIL’s services is billed on a pre-pay basis, unless otherwise agreed by both parties. You agree that our services will not be provisioned until sufficient pre-payment has been made, and that service may be terminated immediately if sufficient pre-payment has not been made. It is your on-going responsibility to ensure that your account maintains the necessary balance to provision the service.
Refunds will only be made for orders within 30 days of completion.
You agree that IMBIL can expire any credit that remains unused for a rolling period of 365 days (if you do not make a call for 365 days the credit will expire). Such expiration renders the balance non-refundable.


Call Service:

 

Mobile Top-Up Service:

  1. Subject to change at any time in the sole discretion of service provider.
  2. We are responsible for collecting all payments for orders you have placed on this website. Payment is authorized at the time the order is placed by you, and the payment will be taken from the bank account registered in your account. The rates for mobile recharges are submitted to change without any prior notice.
  3. We reserve the right to change our rates, fees or payment options at any time without notifying you in advance.
  4. This product is purely designed for residential usage. We will terminate the service agreement if otherwise suspected. This Agreement does not have a minimum or finite duration and will continue to be binding on the parties until it is terminated. We may terminate the Agreement at any time. We reserve the right to process or cancel any transactions in progress on termination of this Agreement or on suspension or withdrawal of the Service.
  5. IMBIL’s is not responsible and will not offer any refunds for any loss you may incur in case of mistyping the recipient's phone number, choosing the incorrect operator or entering incorrect information.
  6. It may take up to 24 hours for the mobile operator to update the credit to the prepaid number you selected.
  7. If VAT, sales tax or any other duty or taxes are imposed on the services we provide, you must pay us, in addition to any announced rate, an additional amount for the taxes added to our services.
  8. Some operators may apply VAT and taxes that will be deducted from the mobile recharge amount based on the local rules of destination network.
  9. Once the recharge is accepted by the operator whose contact information is available on the invoice, the operator becomes responsible for completing the recharge

 

Recurring payments (Topping up your account automatically):

Setting up automatic top-up/crediting is always recommended, as it ensures your account is always credited and ready to make calls. It requires a credit or debit card.

 

By signing up, you are allowing IMBIL to process your payment according to your payment plan.

 

The automatic top-up process is the same as with manual top-ups via credit or debit card. At the final step you'll find the option to activate automatic crediting. You can't set up automatic crediting without performing a manual transaction first.

  1. Please login to your account and find the account top-up menu.
  2. Please select the Top-Up amount (£5, £10, £20). Also select automatic credit amount to add (£5, £10, £20) when your balance drops below £1, £2 or £5.
  3. In the next step, please choose credit or debit card:
  4. Please fill in the credit card details form, check the authorisation box and finish the transaction.
  5. After the top-up has completed, you'll receive a success status message.

Refund:

If you believe that IMBIL has charged you in error, you may request for a refund within 30 days from the purchase date by submitting a written refund request in English to IMBIL’s customer services at 
to support@imbil.co.uk . The refund only would be in the form of call credits. Whatever call credits are been consumed cannot be refunded apart from any special scenario where the call duration bellow 20 seconds can be refunded, conditions apply. Any refund older than 90 days would not be possible. Any package value can only be transferred to call credits after re-evaluating, but would not be refundable. Any promotional product value cannot be refunded with equal value. 

 

No Unlawful or Prohibited Use:

As a condition of your use of the IMBIL’s, you will not use the IMBIL’s for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the IMBIL’s in any manner which could damage, disable, overburden, or impair IMBIL’s or the network(s) connected to IMBIL’s or interfere with any other party's use and enjoyment of any IMBIL’s Service(s). You may not attempt to gain unauthorized access to IMBIL’s Site/Service, other accounts, computer systems or networks connected to any IMBIL’s IMBIL’s Site/Service, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the IMBIL’s Sites/Services.

 

No emergency calls:

The Services do not and are not intended to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care unit or any type of emergency services of any kind and IMBIL’s is not liable in any manner for such calls. In the event that, with your permission, another user uses your Account, you are responsible to inform that user that the Services do not support or carry emergency calls. You must ensure that you, or anyone using your Account/Device, have alternative arrangements for making any such calls.

 

Third party services:
You acknowledge that the use of the Services is dependent upon services of third parties, including but not limited to international carriers, local termination partners and your local telecom and mobile operator ("Provider"). You acknowledge and agree that the Services provided by us are not a traditional mobile or fixed line telephone service or a replacement for your primary telephone service. Note that some Providers prohibit or restrict the use of Voice over Internet Protocol (“VoIP”) functionality or other features of the Services, and may also impose additional fees in connection with the use of the Services. You are solely responsible for verifying with your mobile operator (or any other Provider that you are using in relation to the use of the Services) that the use of the Services is permitted in accordance with any contractual obligations you may have with that Provider, and also to check and pay for such imposed additional fees. Note that, as soon as your call is connected to a phone number provided by IMBIL, the call may be charged by your Provider, regardless of whether you are connected to the receiver of the call or not (i.e. even if the line is busy).
You acknowledge and understand that the Services provided by us are not a traditional mobile or fixed line telephone service or a replacement for your primary telephone service.
In relation to our Mobile Top Up Services, please note that once the Mobile Top Up transaction is completed, IMBIL has no control over the pre-paid airtime value and that the terms and conditions of the recipients local mobile network operator will apply in respect of the end user's consumption of such pre-paid airtime value.

 

Disclosure of Personal Information:
Where we have told you in advance, certain information may be disclosed to third parties such as Third Party Service providers for purposes solely connected with the provision of their services. Where required or permitted by law, information may be provided to others, such as law enforcement or other Government authorities.

 

Termination:
IMBIL reserves the right, in its sole discretion, to terminate your access to all or part of the IMBIL Web Sites, with or without notice.
